Donald Trump is facing a new legal battle following the launch of a controversial subscription service that grants wealthy users early access to his posts on Truth Social. A lawsuit filed in the U.S. District Court for the Southern District of New York by The Intercept and the Freedom of the Press Foundation alleges that the program, known as Truth API, is fundamentally corrupt and unconstitutional. At its center is a tiered pricing model where some subscribers pay as much as 100,000 dollars a month to see updates from Trump and other high ranking officials before they reach the general public.
The plaintiffs argue that because Donald Trump remains the largest shareholder in Trump Media and Technology Group, he stands to profit personally from selling privileged access to information created in his official capacity. This concern is amplified by the fact that Trump frequently uses the platform to announce policies on tariffs or foreign affairs that can cause immediate shifts in global stock and oil prices. The company’s own leadership seems to embrace this volatility, with interim CEO Kevin McGurn describing the service as a high margin product designed to give businesses quick access to market moving content.
Beyond the financial implications, the lawsuit raises serious questions about transparency and the preservation of historical records. While paying members gain access to an extensive archive dating back to 2022, including posts that were later edited or removed entirely, others are being shut out. According to the complaint, there have been active efforts to block third party tools used by journalists and archivists to track these communications, effectively creating a paywall around government activity.
Critics such as Senators Elizabeth Warren and Adam Schiff have previously called on federal regulators to investigate whether this arrangement constitutes illegal market manipulation favoring insiders over average investors. For now, those bringing the suit are asking a judge to declare the system unlawful and prohibit the administration from using Truth Social as an exclusive channel for official announcements so long as preferential access is being sold for a fee. Neither the White House nor Trump Media has yet responded to requests for comment regarding the filing.
